These Terms of Service ("Terms") govern your access to and use of the website at www.seraos.ai , related sites and subdomains, and the services made available through them (collectively, the "Services"). The Services are operated by Inalways Technology Pvt. Ltd., which operates the SeraOS platform and brand ("SeraOS," "Company," "we," "us," or "our").

By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy , which is incorporated by reference. If you do not agree, please do not use the Services.

1. Who May Use the Services

The Services are intended for businesses and for individuals who are at least 18 years old and able to form a binding contract. If you use the Services on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. The Services

SeraOS provides an AI-powered performance-marketing and lead-generation platform and related services, including intent intelligence, campaign personalization, lead qualification, and CRM integration. The content on our Websites is provided for general information about our products and services. Specific services we provide to business clients are governed by a separate written agreement (for example, a Master Services Agreement or order form); in the event of a conflict between such an agreement and these Terms, the separate agreement controls for that engagement.

3. Acceptable Use

You agree not to:

• Use the Services in any unlawful manner or for any unlawful or fraudulent purpose;
• Provide false, misleading, or unauthorized information, or impersonate any person or entity;
• Interfere with, disrupt, probe, or attempt to gain unauthorized access to the Services, our systems, or other users' data;
• Introduce viruses, malware, or other harmful code;
• Scrape, harvest, or collect information about other users without authorization;
• Copy, modify, distribute, sell, or reverse-engineer any part of the Services except as expressly permitted; or
• Use the Services in a way that infringes the intellectual property or other rights of any third party.

We may suspend or terminate access for any violation of these Terms.

4. Submissions and Accuracy of Information

When you submit information through a form, demo request, or other interactive feature, you agree that the information is accurate, current, and complete, and that you have the authority to provide it. You are responsible for the content you submit. We may, but are not obligated to, monitor, remove, or edit content we determine, in our sole discretion, to be unlawful, infringing, or otherwise objectionable.

5. Intellectual Property

The Services, including all software, text, graphics, logos, designs, models, and other content (excluding content you provide), are owned by or licensed to SeraOS and are protected by intellectual-property laws. "SeraOS," "Inalways," and associated logos are our trademarks. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Websites for their intended purpose. No other rights are granted.

6. Third-Party Links and Tools

The Services may provide access to third-party websites, tools, or services that we do not control. We provide them "as is" and "as available," without warranties or endorsement, and we are not responsible for them. Your use of any third-party tool is at your own risk and subject to that third party's terms.

7. Disclaimers

THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Any performance figures, case studies, metrics, or results referenced on our Websites (for example, reductions in cost per acquisition or increases in qualified leads) reflect specific past outcomes and are not a guarantee, promise, or projection of future results. Marketing outcomes depend on many factors outside our control, including your market, budget, offering, and execution. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any particular result will be achieved.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERAOS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE WEBSITES WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100) OR THE AMOUNT YOU PAID US FOR THE RELEVANT SERVICE IN THE PRECEDING TWELVE MONTHS, WHICHEVER IS GREATER. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless SeraOS and its affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Services, your content, or your violation of these Terms or applicable law.

10. Accuracy and Changes to Content

We work to keep information on the Websites accurate, but it may occasionally contain errors, inaccuracies, or omissions. We may correct them and change or update information at any time without prior notice. We are not obligated to update information except as required by law.

11. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date reflects the most recent revision. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to applicable law, the courts located in Pune, Maharashtra, India will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, and you consent to that jurisdiction and venue.

13. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver. These Terms, together with the Privacy Policy and any applicable separate service agreement, constitute the entire agreement between you and SeraOS regarding the Websites.
